Last updated: 1 January 2025. This policy describes how KALM LOGISTICS LTD (company number registered in England & Wales) collects, uses, and protects personal data in accordance with the UK GDPR and the Data Protection Act 2018.

Data We Collect

We collect business contact information (name, email, phone, job title, company name) submitted via enquiry forms, contractual correspondence, and service delivery communications. We do not collect consumer personal data.

How We Use Your Data

Data is used solely to process freight enquiries, manage active service contracts, issue invoices, and fulfil statutory reporting obligations. We do not sell, rent, or share personal data with third parties for marketing purposes.

Legal Basis for Processing

Processing is carried out under the lawful bases of contractual necessity (Article 6(1)(b) UK GDPR) and legitimate interests (Article 6(1)(f) UK GDPR) for enquiry management and fraud prevention.

Retention Periods

Contractual records are retained for six years from the date of last transaction in line with the Limitation Act 1980. Enquiry data not resulting in a contract is deleted within 12 months of last contact.

Your Rights

You have the right to access, rectify, erase, restrict, or port your personal data, and to object to processing. Submit requests to support@kalmlogistics.com. We will respond within 30 days. You may also lodge a complaint with the Information Commissioner's Office (ICO).

Data Security

All data is stored on encrypted UK-based servers. Access is restricted to authorised personnel on a need-to-know basis. We conduct periodic security reviews and report any breach to the ICO within 72 hours where required.

International Transfers

Where freight operations require data transfer outside the UK, we rely on the UK's International Data Transfer Agreements (IDTAs) or equivalent adequacy decisions to ensure lawful transfer.

Terms & Conditions

Last updated: 1 January 2025. These Terms & Conditions govern all freight, warehousing, and logistics services provided by KALM LOGISTICS LTD to its clients. By engaging our services, you agree to these terms in full.

Services & Scope

KALM LOGISTICS LTD provides freight transportation, warehousing, supply chain coordination, customs documentation support, and cargo delivery. The specific scope of each engagement is defined in the written service agreement or confirmed booking.

Service Level Commitments

SLAs are published per lane and modality in the client service agreement. Where KALM fails to meet a published SLA due to its own operational fault, clients are entitled to the remedies specified therein. Force majeure events, port authority delays, and customs holds fall outside SLA scope.

Client Obligations

Clients must provide accurate cargo declarations, complete customs documentation, and timely instruction. KALM accepts no liability for delays or losses arising from incomplete, inaccurate, or late client-supplied information.

Liability

KALM's liability for loss or damage to cargo is limited to the lesser of the actual verified loss or the limit stated in the applicable CMR, Hague-Visby, or Montreal Convention. Consequential and indirect losses are excluded. Clients are advised to maintain cargo insurance.

Payment Terms

Invoices are due within 30 days of issue unless otherwise agreed in writing. Overdue balances accrue interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts Act 1998.

Governing Law & Jurisdiction

These Terms are governed by the law of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Amendments

KALM reserves the right to update these Terms with 30 days' written notice to active clients. Continued use of services after that period constitutes acceptance of the revised Terms.
